14.2 Arbitration Rules and Administration

In the event the AAA is unavailable, we reserve the right to unilaterally select an alternative, recognized arbitration provider.

14.3 Arbitration Procedure

14.4 Class Action and Representative Waiver

14.5 Mass Arbitration Procedures

Should twenty-five (25) or more substantially similar claims be levied against us by the same legal counsel or coordinated entities (a “Mass Arbitration”), the ensuing protocols shall strictly govern:

  • The claims shall be segmented into discrete batches comprising no more than ten (10) claims each;
  • These batches shall proceed through arbitration sequentially, and explicitly not simultaneously;
  • We shall retain the exclusive right to dictate the sequential order in which these batches are arbitrated;
  • Required filing fees for subsequent batches shall not become due or payable until the preceding batches have been fully resolved;
  • The applicable statute of limitations for claims residing in subsequent batches shall be formally tolled.

This specific provision is designed to thwart abusive or duplicative arbitration filings and shall be strictly enforced to the maximum extent permissible under the law.

14.6 Small Claims Exception

Either party retains the right to pursue an individual claim within the jurisdiction of a small claims court, provided the claim meets jurisdictional requirements and is maintained strictly on an individual, non-class basis.

14.7 Opt-Out Right

You may formally opt out of this binding arbitration agreement by transmitting a written notice to [email protected] within exactly thirty (30) days of your initial engagement with the Service.

14.8 California-Specific Limitations

To the maximum extent permissible by law:

  • You formally waive any and all rights afforded under California Civil Code §1542, alongside analogous statutes;
  • You stipulate that California law shall not govern these Terms unless its application is legally unavoidable;
  • You covenant not to initiate claims under California consumer protection frameworks in instances where the law of an alternative jurisdiction is properly applicable.

14.9 Survival

This arbitration agreement shall endure and survive the termination of these Terms, as well as the cessation of your utilization of the Service.

16. VENUE

17. CHANGES TO TERMS

18. SEVERABILITY

Should any individual provision contained within these Terms be adjudicated as legally unenforceable or invalid, all remaining provisions shall endure in full legal force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the complete, entire, and exclusive agreement established between you and Thisnation.com concerning your use of the Service.
